MANILA, Philippines – Tax evasion charges were filed by the Bureau of Internal Revenue (BIR) on Thursday, October 24, against the brothers of Jessica Lucila “Gigi” Reyes, the former chief of staff of Senator Juan Ponce Enrile.
Based on BIR computations, MGNP deprived the government of taxes amounting to P190.14 million.
A criminal complaint was filed with the justice department against MGNP Inc, its president Neal Jose O. Gonzales, and treasurer Patrick Jean O. Gonzales for 3 counts of willful attempt to evade the payment of income and value-added taxes for years 2009, 2011, and 2012.
In addition, they were accused of “deliberate failure” to file annual income tax returns for 2011 and 2012, along with their quarterly VAT returns for 2009, 2011, and 2012.
Likewise, they were charged with “willful failure to supply correct and accurate information” in their income tax return for 2009 and in the VAT return for the 3rd quarter of 2012.
MGNP is in the business of buying and selling any and all properties of every kind and description. The BIR found that after purchasing the Paseo de Magallanes property on Sept 22, 2009, for P43.2 million, MGNP did not declare it in its income tax return for the same year. The property was purchased from Premier Global Links Enterprises Inc.
The company associated with the Gonzales siblings also bought land from C.J. Yulo and Sons Inc in February 2011 for P150 million but failed to file its income tax return and VAT returns for that same year. As a result, it was unable to declare as income the amount of P150 million.
The BIR is also looking into possible tax liabilities of lawmakers who may have acquired wealth through the multi-billion-peso pork barrel scam perpetuated by alleged mastermind Janet Lim Napoles.
The BIR was able to establish MGNP’s unreported income when it applied the expenditure method. When a taxpayer spends more than what he earns and the source of money is unexplained, expenses represent unreported income.
The case against MGNP and the Gonzales brothers is the 195th filed under the BIR’s Run After Tax Evaders (RATE) program. – Rappler.com
