Pinoy Weerkly | Appointment of ex-cop to martial law claims board an insult to victims, rights groups say

Human rights group Samahan ng mga Ex-Detainees Laban sa Detensiyon at Aresto (Selda) slammed the appointment of retired Philippine National Police (PNP) Director Lina Castillo- Sarmiento by Pres. Benigno Aquino to head the Human Rights Victims Claims Board.

Selda stated that the move is an insult inflicted upon the victims by the government. “Sarmiento was part of the Philippine Constabulary that implemented, along with the AFP, the worst of human rights violations during the Marcos dictatorship. How can we accept that?” exclaimed Marie Hilao-Enriquez, chairperson of Selda.

The board shall process the recognition and reparation of martial victims after Republic Act 10368 or Human Rights Victims Reparation and Recognition Act of 2013, enacted last year. The law aims to compensate some 10,000 victims of Marcos dictatorship.

Enriquez also said that despite a provision in the law indicating that the President can accept nominations to the board from Selda, not a single Selda member was appointed. “This is not the real sentiment of martial law victims,” Enriquez said.

Bayan Muna Rep. Neri Colmenares, main author of the law and himself a martial law victim, said that under RA 10368, Sarmiento cannot assume chairmanship of the claims board.

He explained that based on Based on Section 8, Chapter II of RA 10368, an independent and quasi-judicial body to be known as the Human Rights Victims’ Claims Board, composed of nine (9) members, who shall possess the following qualifications: (b) Must have a deep and thorough understanding and knowledge of human rights and involvement in efforts against human rights violations committed during the regime of former President Ferdinand E. Marcos; and (d) Must have a clear and adequate understanding and commitment to human rights protection, promotion and advocacy.

“With these requirements how can a police general become the chair of the human rights body? How can the chair of a human rights board come from an agency historically and currently used for rampant human rights violations? As the former Director of the PNP Human Rights Affairs Office (HRAO) Gen. Sarmiento used to deny these human rights violations and in fact defended the PNP from charges of human rights violations,” Colmenares said.

Bayan Muna will file House Resolution to investigate Sarmiento’s appointment.

Other appointed members of the claims board are Jose Luis Martin Gascon, Byron Bocar, Aurora Parong, Galuasch Ballaho, Jacqueline Mejia, Glenda Litong, Wilfred Asis and Erlinda Senturias.

Paghihiwalay at panunuyo

Pag-amin at pagbabago

Statistics: Unemployment in RP as high as ever. (downloaded photo)

There is an estimated 12.1 million jobless Filipinos or the 27. 5 percent of the working force, according to a Social Weather Stations (SWS) survey for the last quarter of 2013. According to SWS, the unemployment rate rose to 6 percentage points higher than the 21.7 percent in the previous quarter of the same year.

But the presidents’ spokesperson, Edwin Lacierda, said that calamities like typhoons Pablo and Yolanda, and including the earthquake that hit Bohol and Cebu last year, were the only reasons for the rising of unemployment.

In fact, The cause of the present jobs disaster in the country is not Yolanda but the presidents's policies. The administration's dependence on foreign investments and refusal to implement genuine land reform and national industrialization are disastrous for the employment situation in the country.

Even the government’s own data shows that unemployment has been increasing for the last three years. Labor Force Survey also shows that unemployment has been increasing, from 7.1 per cent in 2011 to7.2 per cent in 2012 and to 7.3 per cent in 2013.

The high unemployment rate contradicts the 7.2 economic growth. It is a jobless growth not an inclusive growth.

According to Bong Labog, Chairman of militant labor group KMU, foreign investments in the country are concentrated in mining, real estate, and business process outsourcing which do not create a labor base as broad as that of manufacturing.

The government’s plan of attracting foreign investors to the country is detrimental to Filipino workers as it means the offering up of cheap and repressed labor.

The Aquino government is trying to attract foreign investments by pressing down wages, contractualizing work forces and repressing labor rights. The result is a no-win situation where unemployment is high and workers are impoverished.

Palace downplays country’s downgrading in world press freedom ranking

Presidential Communications Operations Office Secretary Herminio Coloma Jr said the government acknowledges the Philippines' "slight decline" in the rankings.

For the 2nd year in a row and against the backdrop of unsolved media killings and the President's refusal to endorse the Freedom of Information bill, the Philippines dropped in press freedom rankings across the world.

Out of 180 countries surveyed by Paris-based organization Reporters Without Borders or Reporters Sans Frontieres (RSF), the Philippines ranked 149th in the 2014 World Press Freedom Index. It dropped even further from 147th in 2013 and 140th in 2012.

The results of the survey come two months after the killing of 3 media practitioners within just two weeks. (READ: Gov't probes media killings)

The index ranks countries based on the following criteria:

· pluralism or options presented to the media

· media independence or the degree to which media are able to function independently of authorities

· environment and self-censorship

· legislative framework or the quality of legislative framework and its effectiveness

· transparency

· infrastructure

The report did not specify what contributed to the Philippines' low rankings.

According to Phelim Kine, deputy Asia HRW director, “The body count of Filipino journalists speaks volumes for the wide gap between the Aquino government’s rhetoric in addressing rights problems and the reality on the ground,”

12 journalists were killed in 2013, bringing the total number of members of the media killed to 26 since President Benigno Aquino III assumed office in June 2010.

Police have arrested suspects in only six of the 26 cases of media killings. Of these cases, the government has only secured convictions in two cases only, the HRW said.

The Philippines hit its lowest ranking in the World Press Freedom Index in 2010 after the November 2009 massacre of 58 people in Ampatuan, Maguindanao in November. At least 32 journalists were killed in the incident. Four years after, the case remains unsolved.

MANILA, Philippines - The Commission on Elections is considering a pilot test of online voting among overseas Filipino workers (OFW), according to Comelec Commissioner Lucenito Tagle.

Tagle said voting via the Internet is authorized under Republic Act 10590 or the Overseas Absentee Voting Act of 2013. Under the law, the Comelec “may explore other more efficient, reliable and secure modes or systems, ensuring the secrecy and sanctity of the entire process, whether paper-based, electronic-based or internet-based technology or such other latest technology available.”

If the poll body's plan pushes through, the agency will conduct the trial among seamen and land-based OFWs in the Middle East for the 2016 elections.

“We are eyeing seafarers because they are the ones who have difficult in voting and land-based workers in the Middle East because they are the ones who are usually not allowed by their employers to skip work to vote,” Tagle said.

But the Comelec isn't expected to abruptly decide on the matter even with a law that permits it because of security issues associated with online voting, according to Tagle.

“If ever, this may have to be approved by the JCOC (Joint Congressional Committee on Elections). A bidding will have to be done. So there is really a long process that we have to do,” he said.
